Ecclesiastes

  קֹהֶלֶת

These 3 paragraphs from the book of King Solomon (Kohelet- Chapter 3) are very relevant for our times, especially for those involved in any way with the judicial system.

 

מַה-שֶּׁהָיָה כְּבָר הוּא, וַאֲשֶׁר לִהְיוֹת כְּבָר הָיָה; וְהָאֱלֹהִים, יְבַקֵּשׁ אֶת-נִרְדָּף

וְעוֹד רָאִיתִי, תַּחַת הַשָּׁמֶשׁ:  מְקוֹם הַמִּשְׁפָּט שָׁמָּה הָרֶשַׁע, וּמְקוֹם הַצֶּדֶק שָׁמָּה הָרָשַׁע

אָמַרְתִּי אֲנִי, בְּלִבִּי--אֶת-הַצַּדִּיק וְאֶת-הָרָשָׁע, יִשְׁפֹּט הָאֱלֹהִים:  כִּי-עֵת לְכָל-חֵפֶץ, וְעַל כָּל-הַמַּעֲשֶׂה שָׁם

 

That which is hath been long ago, and that which is to be hath already been; and God seeketh that which is pursued.

And moreover, I saw under the sun, in the place of justice, that wickedness was there; and in the place of righteousness, that wickedness was there.

I said in my heart: 'The righteous and the wicked God will judge; for there is a time there for every purpose and for every work.'

"Rashi" says: "Ultimately man will be held to account for his deeds". Meaning every man will pay for his sins but it is necessary to understand the last verse because it is not a statement but a question. Who is the real righteous and who is the wicked? And the answer is the Almighty will judge.

The reality

The reality is that "de facto", a human being is judged (by a judge in a courtroom) in this world and his or her judgment is not necessarily the correct one. What G-d will decide, we don't know.

How many of us feel trapped in a situation we call: a travesty of justice, injustice, evil or any other word we use to emphasize "lack of justice"?

In practice

In practice we can and should try everything we can to prove we are right, to show injustice has been done to us, but at some point, we will need to accept the facts and understand that we cannot "win" and it is time to let it go.

Unfortunately, too many lawyers are occupied in selling dreams to their clients. This is often the reason an agreement (a compromise) cannot be reached between the parties because they are convinced that they will have the upper hand, they will win. Both parties are totally convinced, but as we know only one will have his/her way.

The wise

Our sages told us: אֵיזֶהוּ חָכָם – הָרוֹאֶה אֶת הַנוֹלָד – Who is the wise man? He who sees what's going to be born or the one who sees the consequences of his actions.

 

If you are stubborn or if you believe in fairytales told by others, or you are one of those seeking justice, I suggest you have in mind what I wrote above: In this world, his or her judgment is not necessarily the correct one.

You will find out very fast that judges are just mortals and are very often just “failable” (fallible).
