Technology and the Courtroom

In the past, in many cases I had and my coworkers had, the judge would not give any discount to the sides involved – as an example:

If a plaintiff lives in the U.S., he must show up in court for the hearing and is not allowed by the judge to appear in a video conference. As a result, many plaintiffs have given up suing in Israel because of the costs of traveling (especially because a lawsuit can be more than one hearing). The defendant has had no other choice but to defend himself and show up in court. Many times, a plaintiff sued someone abroad just to torte him/cause him damages, etc.

The system was never fair but it was and still is very formal. Formalities are too many judges more essential and more important than justice.

Criminals were brought to courtrooms every day. A dozen of them some days. Many of them with their hands and legs in handcuffs. Criminal courtrooms looked like an arena of bullfighters.

COVID and the New Rules

Corona changed all that. Not only did the rules and laws change, the perception and approaches of the judges changed as well.

Inmates and criminals that are not going to be released do not come to court anymore. The judge “listens” to cases by video conference, which costs much less than bringing the suspect to a courthouse as there is no need for all the security needed when an inmate must appear in court.

Today

Many things have changed. Judges have learned to question by video conference and judges are getting used to the idea that a courtroom is not a necessity. In the future, there will be no courtrooms but only virtual courtrooms. The costs for the real estate, security, maintenance, the cost of the land, and the construction are extremely high.

Other Things that Will Change in the Near Future

Notary services will change drastically, especially now that the technology related to face recognition is getting better. Your signature will be electronic and the notarized document will be sent by technology.

There are many changes coming soon. Some will be very painful, but we all will get used to the new ways and innovative tools.

Technology and bureaucracy will need to learn to live together. So far, bureaucracy is the main problem of the legal system.
